Terms & Conditions

These terms and conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Claims are deemed to form part of the terms and conditions and by participating, all claimants will be deemed to have accepted and be bound by the terms and conditions. Please retain a copy for your information.

  1. This promotion is only open to residents of the United Kingdom and Republic of Ireland aged 18 or over, excluding employees of the Promoter their families, agents or anyone else professionally connected with this promotion.
  2. Purchase Period: 00:00 on 15.02.2024 to 23:59 on 21.06.2024.
  3. Claim Period: 00:00 on 15.03.2024 to 23:59 on 03.08.2024. No claims accepted past this date.
  4. Purchase necessary. Internet access required.
  5. Please retain receipt or online order confirmation as it will be required to validate your claim. The proof of purchase can only be used for one claim. Attempts to enter the same receipt multiple times may result in disqualification.
  6. The promotional product included in this promotion, along with the maximum claim values (subject to availability and whilst stocks last):
    Coole Swan Cream Liqueur 700ml (max. claim value of £26/€26).
  7. To Claim: Purchase promotional product during the Purchase Period then visit the promotional website moneyback.cooleswan.com at least 30 days after date of purchase. Complete the online registration form by entering your personal details including full name, home address, email address, date of birth and UK or ROI bank details (if preferred payment route is via bank transfer as opposed to PayPal) during the Claim Period. You will need to provide a minimum of 15 words explaining what can be done to improve the product and upload a photo of your itemised purchase receipt or online order confirmation. The proof of purchase will need to show the purchase of a Coole Swan promotional product from a participating retailer and must be dated within the Purchase Period and before the date of claim. The receipt must be uploaded in the format of1 PNG, BMP, or JPG/JPEG and a maximum file size limit of 20MB applies. Please keep your original itemised receipt as it may be required to further verify a claim. Each receipt can only be used for a maximum of one claim.
  8. This is a consumer promotion only and neither retailers nor wholesalers may apply. One claim per household.
  9. All claims must be received by the Claim Period closing date. Any claims received after this date will not be accepted and will not be considered a valid claim.
  10. If a claimant’s claim is valid, they will receive email confirmation and a refund for the cost of the purchased promotional product only up to the maximum claim value shown in Condition 6. If purchased on promotion, the full retail price stated on the receipt for one purchase will be refunded. This will be sent by PayPal or Bank Transfer as requested by the claimant. Please allow up to 28 days for delivery from receipt of a valid claim and the completion of any verification process.
  11. Claimants who make a claim on someone else’s behalf will be disqualified, at the Promoter’s discretion.
  12. The Promoter may, in its sole discretion, invalidate claims deemed to be in breach of these Terms and Conditions, contrary to the spirit of the promotion or otherwise bring the promotion into disrepute.
  13. The Promoter reserves the right to verify the eligibility of claimants. The Promoter may require such information as it considers reasonably necessary for this purpose including but not limited to asking for proof of receipt/online order confirmation and ID (passport, driving licence or equivalent). A claim may be withheld unless and until the Promoter is satisfied with the verification.
  14. It is the responsibility of the claimant to provide correct, up-to-date details when entering their claim. The promoter cannot be held responsible for claimants failing to supply accurate information which affects fulfilment of their claim.
  15. The Promoter accepts no responsibility for lost, delayed, incorrectly submitted, illegible, incomplete or misdirected claims or for technical failures or otherwise. Proof of sending is not proof of receipt.
  16. By entering the promotion, claimants agree to be bound by these Terms and Conditions and by the decisions of the Promoter, which are final in all matters relating to the promotion. No correspondence will be entered into. 
  17. Claims are non-transferable and cannot be exchanged for any cash alternatives in whole or in part.
  18. The Promoter reserves the right to vary these Terms and Conditions or to terminate or cancel the promotion and/or a reward at any time without notice. For instance, if for any reason any aspect of this promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter may in its sole discretion terminate, modify or suspend the promotion, or invalidate any affected claims.
  19. The Promoter has no control over internet or communication networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter will not be held liable to any individual for any fraud committed by any third party nor for any event beyond its control including, but not limited to, user error and any network, computer, hardware or software failures of any kind which may restrict, delay or prevent a participant’s claim.
  20. Claims (bulk or otherwise) made from trade, consumer groups or third parties will not be accepted. Claims, by or via third parties or syndicates, claims by macros or other automated means (including systems which can be programmed to enter), and claims which do not satisfy the requirements of these Terms and Conditions in full will be invalidated.
  21. In entering into this promotion, claimants do so at their sole risk. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or requesting or receiving the claim, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law. This promotion does not affect the statutory rights of the claimant.
  22. By entering the promotion, all claimants consent to the transfer of their personal data to the Promoter and its agencies, and the holding and processing of such data by the Promoter and its agencies, and for the purposes of the administration of this promotion. If you do not wish your personal data to be used for this purpose, you should not enter the promotion.
  23. The Promoter will only use the personal details supplied for the administration of the promotion and for no other purpose, unless we have your consent. Your personal details will at all times be kept confidential and in accordance with current Data Protection legislation. Visit https://cooleswan.com/privacy-policy/ for the Promoter’s Privacy Policy. Data will be stored for 3 months after the close of the promotion before deletion. You can request access to your personal data, or have any inaccuracies rectified, by sending an email to cooleswan@promotioncustomerservices.com. By participating in the promotion, you agree to the use of your personal data as described here.
  24. If any provisions of these Terms and Conditions are judged to be invalid, illegal or unenforceable, this shall not affect or impact the continuation in full force and effect the remainder of the provisions.
  25. Participation in the Promotion is deemed acceptance of these Terms and Conditions.
  26. This Promotion and all issues arising out of it shall be governed in accordance with English Law and are subject to the exclusive jurisdiction of the English and Welsh Courts.  However, if you live in the Republic of Ireland or in another part of the UK, your local courts will have jurisdiction.
